Many employees in the Netherlands have legal insurance. What not everyone knows: you have the right to choose your own lawyer through free choice of lawyer and have the costs largely reimbursed by your insurer.

Employers may also have business legal insurance in certain cases. In practice, this occurs less frequently. If you do have a policy as an entrepreneur or SME business, the same right applies.

What does free choice of lawyer mean?

Free choice of lawyer means that in a legal dispute, you are not obligated to use your insurer’s lawyers. You may engage your own specialized attorney. The costs are usually fully or largely reimbursed by your insurer, as long as the dispute falls under the coverage.

When does this right apply?

Your right to free choice of lawyer applies as soon as there is a judicial or administrative procedure. This includes:

  • a dismissal procedure at the district court
  • a wage claim or dispute over a non-compete clause
  • a dismissal application at the UWV, for example in case of economic dismissal or long-term disability
  • appeal

Even if the insurer has already deployed its own lawyers, you can still choose a specialized employment law attorney.

What does the insurance cover?

Coverage varies per policy, but generally:

  • Attorney fees are reimbursed up to a certain maximum.
  • A deductible or contribution may apply.
