Employee participation is not a formality, but an essential part of employment law and well-organized decision-making. In professional organizations, the works council (WC) is a serious discussion partner for major decisions. However, the role of employee participation in reorganizations, policy processes, or mergers regularly raises questions in practice. What are the formal rights? What does a careful process look like? Well-organized employee participation adds value. But then it must be legally sound and strategically well-deployed.
